Plod & Ponder Publications respects the intellectual property rights of creators and adheres strictly to the notice-and-takedown procedures established in Title 17, United States Code, Section 512 of the Digital Millennium Copyright Act (DMCA).

2. Statutory Takedown Notification Checklist (17 U.S.C. § 512(c)(3))

If you believe that your copyrighted work has been copied or made available on Plod & Ponder in a manner that constitutes copyright infringement, please provide our Designated Agent with a written notice containing all of the following elements:

Physical or Electronic Signature:A physical or electronic signature of a person authorized to act on behalf of the copyright owner.

Identification of Copyrighted Work:Identification of the copyrighted work claimed to have been infringed (or if multiple works are covered by a single notification, a representative list).

Exact Infringing URL & Location:Specific identification of the material claimed to be infringing, including exact URL links on plodponder.com to enable rapid location and review.

Contact Information:Full legal name, mailing address, telephone number, and email address of the complaining party.

Good Faith Affirmation:A statement that the complaining party has a good faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.

Statement Under Penalty of Perjury:A statement that the information in the notification is accurate, and under penalty of perjury, that the complaining party is authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.

3. Counter-Notification Procedure (17 U.S.C. § 512(g))

If material that you posted or contributed has been removed or disabled as a result of a DMCA takedown notice and you believe such removal was the result of mistake or misidentification, you may submit a formal counter-notification to our Designated Agent containing:

  • Your physical or electronic signature.
  • Identification of the material that was removed or disabled and the URL location prior to removal.
  • A statement under penalty of perjury that you have a good faith belief the material was removed or disabled as a result of mistake or misidentification.
  • Your legal name, address, telephone number, and email address.
  • A statement consenting to the jurisdiction of the Federal District Court for the judicial district in which your address is located (or Charleston County, SC if outside the United States), and that you will accept service of process from the person who provided the initial infringement notification.

4. Repeat Infringer Policy

In accordance with 17 U.S.C. § 512(i)(1)(A), Plod & Ponder maintains a policy of terminating, in appropriate circumstances, the account, submission privileges, or access of users or contributors who are found to be repeat infringers of intellectual property rights.
